Denied Boarding Claim


Denied Boarding Compensation Claims

Anyone who has ever been denied boarding or bumped from a flight without a reasonable explanation may be entitled to compensation of as much as 600 Euros under EU Regulation EC 261/2004.

Denied boarding is a situation which prohibits passengers from boarding a flight even if they have a valid flight reservation and are on-time for check in. Another common term for such an eventuality is when a passenger is involuntarily ‘bumped’ from the flight.

An airline has the capability of booking you a seat on an alternative flight; should this flight encounter a delay of more than three hours you can also claim for compensation too

Should a passenger be denied boarding or be ‘bumped’ from the flight without a reasonable explanation, an airline must offer them an alternative flight or a full refund for the price of their flight ticket under EU Regulation EC 261/2004.

What Compensation Am I Entitled To?

How Much Denied Boarding Compensation Can I Receive?

The amount of denied flight boarding compensation – or compensation anywhere in the UK – is dependent on the length of the delay after you’ve been denied boarding and the distance travelled. Generally, the longer the delay and the longer the distance travelled, the greater the amount of compensation that you could be owed.

HOW MUCH COMPENSATION CAN I CLAIM FROM THE AIRLINES?

The flight compensation amount is set by the EU Law, EU Regulation 261/2004. The amount will be based on the length of the delay and the flight distance. They are not related to the cost of your ticket, so whether you paid £50 or £1000 for your ticket, the amount of compensation stays the same.

Regulation (EC) 261/2004 states that all airlines should compensate passengers if a flight is heavily delayed or cancelled. They must also offer meals, refreshments and hotel accommodation (if appropriate) while you wait for a rearranged flight. It is the airlines duty to cover the transport costs between the hotel and airport, regardless of the costs incurred.  If the airline does not provide this service then keep all receipts so that you may to claim reimbursement from the airline.

Yes. The passenger is the only person who would be entitled to claim, not the person who paid for the ticket. (Unless that person was with you, in which case you would both be entitled to claim).  Provided the ticket was purchased and paid for and was not free.

Under the English law there is a time limit of six years to claim, so you cannot claim any further back than flights in the last six years.

If your flight departed more than three hours late but landed under three hours late by making up lost time in air within the journey, then you are not entitled to compensation. But if the flight departed and arrived more than three hours late then you are entitled to claim.

Airlines refer to an ‘extraordinary circumstance’ as anything unexpected or outside of their control and they do not have to pay compensation if your delay was caused by “extraordinary circumstances”.
