The conveyancing process normally consists of three different parts which are:
Before Contract
- The conveyancer will arrange local searches, organise a survey and review it.
- We will get the draft contract, arrange the mortgage paperwork, and carry our pre-contract enquiries between ourselves, and the other solicitors involved.
- Conveyancer reports back to the buyer on the results of the enquiries and searches.
- When the buyer is satisfied, arrangements are made for the deposit to be paid and the contracts signed.
Before Completion
- The formal exchange of contracts is agreed between the buyer’s and seller’s solicitors.
- At this stage, both parties are legally committed to completing the transaction.
- Transfer deeds are drafted up in preparation for completion, in addition to carrying out pre-completion searches.
- The buyer’s conveyancer will apply for the mortgage at this point.
After Completion
- Upon completion, the buyer’s funds are sent to the seller’s solicitors. The keys are then released to the buyer.
- Title deeds are then sent on to the buyer’s solicitors.
- Buyer’s solicitors arrange the payment of Stamp Duty Land Tax unless the property was purchased during a Stamp Duty Holiday or is exempt.
- Formal registration of the new owner and Land Registry notification occurs immediately after completion.
