What Is Conveyancing?
The legal process of conveyancing relates to the transfer of property from one party to another. The role conveyancing solicitors paly in that process is a hugely important one. Here at Versus Law we have an expert team that is ideally placed to assist you with any property sale or purchase. The aim of our team is to deliver accurate and trustworthy advice to guide you safely through the process.
It is only on completion of the conveyancing process that the transfer of any property is deemed to be legal. The conveyancing process consists of extremely strict guidelines which need to be adhered to, to ensure the legality of any property transfer. These guidelines cover things such as all related paperwork, mortgage offers and signing of contracts.
The conveyancing process consists of three different parts. Irrespective of whether you are looking to buy or sell a property, our conveyancing solicitors are here to ensure the process goes as smoothly as possible.
The three different stages are:
Before Contract
- The conveyancer will arrange local searches, organise a survey and review it.
- We will get the draft contract, arrange the mortgage paperwork, and carry our pre-contract enquiries between ourselves, and the other solicitors involved.
- Conveyancer reports back to the buyer on the results of the enquiries and searches.
- When the buyer is satisfied, arrangements are made for the deposit to be paid and the contracts signed.
Before Completion
- The formal exchange of contracts is agreed between the buyer’s and seller’s solicitors.
- At this stage, both parties are legally committed to completing the transaction.
- Transfer deeds are drafted up in preparation for completion, in addition to carrying out pre-completion searches.
- The buyer’s conveyancer will apply for the mortgage at this point.
After Completion
- Upon completion, the buyer’s funds are sent to the seller’s solicitors. The keys are then released to the buyer.
- Title deeds are then sent on to the buyer’s solicitors.
- Buyer’s solicitors arrange the payment of Stamp Duty Land Tax unless the property was purchased during a Stamp Duty Holiday or is exempt.
- Formal registration of the new owner and Land Registry notification occurs immediately after completion.
