Seven Key Steps To Take If You Have Been Involved In A Road Traffic Accident
- Take Note of the date and time.
- Note the vehicle registration, make, model and colour of the other car.
- Write down a brief description of the other driver.
- Take note of the number of passengers in the other vehicle (if any).
- Exchange details such as names, addresses, telephone numbers, insurance companies and policy numbers with the other driver.
- Check if there were any witnesses at the scene of the accident and approach them for a name, address and contact number.
- Take as much photographs as possible of the location, damage and the other driver including all passengers.
- Attend your GP if you have been injured. Attendance is not compulsory but if you are still suffering from your injuries it is better if you obtain medical advice.
- Keep a diary of your injuries.
- Keep a receipt of all expenses.
- Report the incident to the Police if the driver is uninsured or did not stop at the accident scene. Keep a note of the Police reference number.

What can I claim for?
If you have suffered losses as a result of the accident then you are entitled to make a claim to recover the losses from the Defendant / Defendant insurer.
PERSONAL INJURY
You are entitled to make a claim for injuries suffered as a result of the accident. Some injuries may be very severe but the most common injury resulting from an accident is whiplash.
Whiplash injury is caused with sudden movements of the head and neck and the most common injuries suffered can result in pain to the neck, shoulders, headaches and back pain.
The injury may last a couple of weeks, several months or even several years, we will best advise you on how to proceed with your claim.

VEHICLE DAMAGE
You are entitled to make a claim for any damage to your vehicle as a result of the accident. The Defendant will be liable to put the vehicle back in its position had the accident not have happened. If the vehicle is repairable then the Defendant will be liable for the repair cost and if the vehicle is a total loss then the Defendant will be liable for the pre accident value of your vehicle.
HIRE
If your vehicle is unroadworthy or may be in for repairs, then you have the right to a replacement vehicle subject to certain conditions. Please contact us for advice regarding the hire claim.
STORAGE AND RECOVERY
If your vehicle was recovered and or was placed in storage because it was not possible to keep on the road or at your property then you are entitled to make a claim for the recovery and storage charges.
LOSS OF USE
If you do not have access to your damaged vehicle and choose not to hire a replacement vehicle then you can claim loss of use, which on average recovered amount is £15-£20 per day.
GENERAL EXPENSES / TRAVEL EXPENSES
If you have reasonable general expenses (i.e. medicine, clothing, etc) and travel expenses as a result of the accident then please keep all receipts and we will claim the expenses back on your behalf.
LOSS OF EARNINGS
If you have had to take time off as a result of the accident, then you will be able to make a claim for loss of earnings.
OTHER LOSSES
The claim for losses is unlimited to all reasonable losses resulting from the accident.
The losses may be past losses but if the accident has affected future losses, i.e. earnings, job prospects, holidays etc, then the claim may be significant and you will need an experienced solicitor helping you with the claims process.
As a result of the accident you may wish to have private treatment, such as private consultations, surgeries, physiotherapy, CBT (for non physical injuries such as stress, depression etc) and you will be able to claim for the same from the Defendant and we can help you with this.
If you have been cared for by family, friends or a private company as a result of the accident, then you are entitled to make a claim on their behalf for the cost of the care. If a family member or friend provided care, then you can claim an hourly rate on their behalf depending on the care provided.
