Delayed Flight Claim

If your flight’s delayed for 2 or more hours

Your airline has to give you (in the form of vouchers):

  • food and drinks
  • access to phone calls and emails
  • accommodation if you’re delayed overnight – and transport transfers to and from the hotel

Be sure to ask the airline for the above if they are not automatically offered. If they don’t give you help at the airport, keep receipts for expenses incurred so that you may try claim them back later. Be aware that airlines only pay for ‘reasonable’ expenses so be sure to spend wisely. Alcohol, expensive meals and luxury hotels would not be considered a ‘reasonable expense’.

 

If your flight’s delayed for 3 or more hours

You already have a legal right to all of the above mentioned at the 2 hour mark. Once the delay passes the 3 hour mark, you then become entitled to compensation. (Provided the delay was not caused by extraordinary circumstances which could not have been avoided.)

Your compensation amount will be based on the following factors:

  • the length of the delay – if your flight is delayed taking off but the pilot makes up the time in the air, then you will not be entitled to claim)
  • the distance of the flight
  • your destination (whether you’re final destination is an EU or non-EU destination)

 

If your flight’s delayed for 5 hours or more

You don’t have to take the flight if it’s delayed for 5 hours or more. It doesn’t matter whose responsibility the delay is.

If you choose not to take the flight

The airline is legally obligated to provide you with the following:

  • a full refund for the flight
  • a full refund for other flights from the airline that you won’t use in the same booking. (example: your return flight and your connecting flight)
  • , a flight back home (original departure destination) if it is your connecting flight within your journey
  • food and drinks
  • access to phone calls and emails
  • accommodation if you’re delayed overnight – and transport transfers to and from the hotel

 

If you choose to take the flight

You can still claim  compensation  provided the delay was not caused by extraordinary circumstances which could not have been avoided.
